What is Distracted Driving?

Distracted driving is anything that diverts attention from the act of operating the vehicle. This can include visual distractions like billboards or turning to talk to a passenger; manual distractions like adjusting the radio or eating; and cognitive distractions like daydreaming or mentally planning out your day.

Some things, like cellphone use, involve all three types of distraction. This is one of the primary reasons it is illegal to use a cellphone while driving in New York State. Unless, of course, that cellphone is hands-free. This, however, is a false sense of security. While not illegal, studies have found that hands-free and voice-activated devices pose a higher distraction risk than handheld cellphones and tablets.

What to do When Injured by a Distracted Driver

When you’re involved in an accident caused by a distracted driver, it is important that you take steps to protect yourself.

If possible, try to document the scene by taking pictures. Gather contact information from any witnesses and be sure to get the driver’s license number, insurance information, and contact information of any involved drivers.

You will want to see a doctor as soon as possible after your accident. Even if your injuries seem minor, it is a good idea to have a physician examine your internal organs and brain to help identify any damage that has been done.
